These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you” or “User”) and Harrison Weaver, operating as a sole-trader under the business name The Trading Terminal (“we”, “us”, or “the Sole-Trader”), accessible at thetradingterminal.com (“the Service”). By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service.
1. The Service — What It Is and Is Not
1.1 The Trading Terminal is a web-based trading journal and analytics tool that allows you to log and analyse your own trades, manage trading account records, and review performance metrics.
1.2 IMPORTANT — NOT FINANCIAL ADVICE. The Service is a journaling and analytics tool only. We do not:
provide financial, investment, or trading advice of any kind;
act as a broker, dealer, fund manager, or financial intermediary;
execute, recommend, or facilitate trades in any financial instrument; or
guarantee the accuracy or completeness of any analytical output.
Nothing in the Service or any communication from us constitutes a recommendation to buy, sell, hold, or otherwise deal in any security, currency pair, derivative, or other financial instrument. Trading involves substantial risk of loss, and you are solely responsible for all trading decisions you make.
2. Eligibility and Account Registration
2.1 You must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) to use the Service.
2.2 You may register using an email address and password, or via a one-time passcode / magic link. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. Notify us immediately at support.thetradingterminal@gmail.com if you suspect unauthorised access.
2.3 You must provide accurate and up-to-date information when registering. You may not create accounts on behalf of third parties without their express authorisation.
3. Plans, Pricing, and Billing
3.1 Subscription Plans
We offer three subscription tiers:

We reserve the right to adjust plan features and limits at any time. If we make a material change that negatively affects an active paid subscription, we will give you reasonable notice and, where required, an opportunity to cancel without penalty.
3.2 Free Trial
Elite includes a one-time 7-day free trial, available once per user. A valid payment method is required to start the trial. If you do not cancel before the trial period ends, your payment method will automatically be charged for the first Elite billing period and your subscription will continue on a recurring basis until cancelled. You may cancel at any time during or after the trial with no penalty.
3.3 Billing and Renewal
3.3.1 Paid subscriptions are billed in advance on a monthly or annual cycle, depending on your chosen billing frequency. All amounts are in United States Dollars (USD) unless stated otherwise.
3.3.2 Subscriptions renew automatically unless you cancel before the renewal date via Settings → Billing. Cancellation stops future billing; your access continues until the end of the current paid period.
3.3.3 All payments are processed by Stripe, Inc. We do not store full card numbers; payment data is handled entirely by Stripe in accordance with Stripe's own terms and privacy policy. We are not liable for payment processing errors, outages, or failures attributable to Stripe.
3.4 Price Changes
We may change subscription prices at any time with at least 30 days' written notice to existing subscribers (delivered by email or in-app notification). Price changes will apply to your subscription from the next renewal date following the notice period. If you do not wish to continue at the new price, you may cancel before the next renewal without penalty.
3.5 Promotional Codes and Discounts
We may issue promotional or discount codes (“Promo Codes”) from time to time. Promo Codes:
are subject to any specific terms and conditions stated at the time of issuance;
may be restricted to specific users, time periods, or plans;
may be single-use and are not transferable;
may be modified, revoked, or expired by us at any time; and
cannot be combined with other offers unless expressly stated.
Abuse of Promo Codes — including sharing single-use codes, attempting to redeem a code that has already been used, creating multiple accounts to circumvent single-use restrictions, or any other conduct designed to gain an unintended benefit — may result in immediate termination of your subscription without refund.
3.6 Refunds
You may request a full refund within 14 days of the start of your first paid billing period – Please note: you will lose access to your subscription immediately after requesting a refund. After that, all purchases are final and non-refundable, except as required by applicable law, including any statutory consumer guarantees under Australian Consumer Law. To request a refund within the eligible window, contact us at support.thetradingterminal@gmail.com.
3.7 Downgrades and Plan Changes
If you downgrade to a plan with lower limits, or if your subscription lapses to Free:
No data will ever be deleted automatically.
Trading accounts and trades that exceed your new plan's limits will become read-only until you either upgrade again or remove the excess data manually.
You can re-upgrade at any time to restore full access.
4. Your Account Data and Content
4.1 Ownership
You retain full ownership of all trade entries, notes, screenshots, tags, setups, and other content you submit to the Service (“Your Content“). You grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you. We will not use Your Content for any other purpose, including training machine-learning models, advertising, or sharing with third parties, except as described in our Privacy Policy.
4.2 Broker API Keys (Elite Tier — Auto-Logger)
If you use the Auto-Logger feature, you may connect third-party broker accounts (MT5, cTrader) by providing API credentials. You acknowledge and agree that:
These credentials are stored securely on your behalf solely to enable the Auto-Logger feature.
We use the broker API in read-only mode for trade logging purposes only. We retrieve your trade entry and exit data, prices, lot sizes, and related trade details. We have no authority to place trades, withdraw funds, or otherwise interact with your broker account beyond reading trade history.
You are responsible for ensuring your broker permits third-party read-only API connections.
You may revoke API access at any time via your account settings.
4.3 Data Deletion
You may request deletion of your account and all associated data at any time by contacting us at support.thetradingterminal@gmail.com. Deletion requests will be processed within 30 days. Backups and logs may retain data for a short additional period before permanent removal, as described in our Privacy Policy.
5. Acceptable Use
You agree not to:
use the Service for any unlawful purpose or in violation of any applicable law or regulation;
reproduce, resell, sublicense, or provide access to the Service to any third party without our written consent;
share your account credentials with others or allow multiple individuals to use a single account simultaneously;
reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service;
scrape, crawl, or systematically extract data from the Service by automated means;
interfere with or disrupt the integrity or performance of the Service or its infrastructure;
transmit any malware, viruses, or other harmful code through the Service;
use the Service to store, process, or transmit data to which you do not have lawful rights; or
circumvent any access controls, usage limits, or security features of the Service.
6. Intellectual Property
6.1 The Service — including its software, design, interface, trademarks, and all content we create (Excluding News which is provided by ForexFactory) — is owned by HARRISON WEAVER and protected by intellectual property laws. Nothing in these Terms grants you any ownership interest in the Service.
6.2 You may not copy, adapt, or create derivative works from any part of the Service without our express written consent, except as permitted by applicable law.
7. Service Availability and Disclaimer of Warranties
7.1 We provide the Service on an "as is" and "as available" basis. We make no warranty — express, implied, or statutory — that the Service will be uninterrupted, error-free, or free of defects.
7.2 We do not guarantee the accuracy, completeness, or timeliness of any analytics, P&L calculations, or other data outputs generated by the Service. All outputs are derived from the data you input, and you are responsible for verifying that input data is correct.
7.3 We may suspend, modify, or discontinue the Service (or any feature) at any time, with or without notice, for maintenance, legal, or operational reasons. Where possible, we will provide reasonable advance notice of significant interruptions.
8. Limitation of Liability
8.1 To the maximum extent permitted by applicable law, the Sole-Trader’s total liability to you for any claim arising out of or relating to these Terms or the Service — whether in contract, tort (including negligence), or otherwise — is limited to the total amounts you paid to us in the 12 months preceding the event giving rise to the claim, or AUD $100 (whichever is greater).
8.2 In no event will the Sole-Trader be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption.
8.3 We are not liable, under any circumstances, for:
any trading losses you incur, regardless of whether analytics or outputs from the Service influenced your decisions;
errors or omissions in data you enter into the Service;
outages, errors, or failures attributable to Stripe, Supabase, Vercel, or any other third-party provider;
unauthorised access to your account resulting from your failure to maintain credential security; or
any decisions — financial or otherwise — you make based on data, analytics, or outputs from the Service.
8.4 Some jurisdictions do not permit the exclusion or limitation of certain warranties or liability. Where such laws apply, our liability will be limited to the minimum extent permitted by law.
9. Termination
9.1 You may cancel your account at any time via Settings → Billing or by contacting us. Upon cancellation, access continues until the end of your current paid period (if applicable).
9.2 We may suspend or terminate your account immediately if:
you materially breach these Terms and fail to remedy the breach within 7 days of written notice;
you engage in abuse of Promo Codes, as described in clause 3.5;
we are required to do so by law or a court order; or
we reasonably believe your use of the Service poses a security or legal risk.
9.3 On termination by either party, your right to access the Service ceases. Your data will be retained for 30 days after termination to allow you to request a data export, after which it will be deleted in accordance with our Privacy Policy. No refunds will be issued for the remaining portion of a prepaid period where termination results from your breach.
10. Governing Law and Disputes
10.1 These Terms are governed by and construed in accordance with the laws of South Australia, Australia. The parties submit to the exclusive jurisdiction of the courts of South Australia.
10.2 Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute by contacting us at support.thetradingterminal@gmail.com. We will endeavour to respond within 14 business days.
10.3 We encourage resolution of disputes through direct communication wherever possible before any formal proceedings are commenced.
11. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and the Sole-Trader regarding the Service and supersede all prior agreements, representations, or understandings.
Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed from these Terms without affecting the validity and enforceability of the remaining provisions.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations (including on a sale of the business) without restriction, provided that we notify you and the assignee assumes our obligations to you.
Waiver. Our failure to enforce any provision of these Terms will not be deemed a waiver of our right to enforce it in the future.
Notices. Notices from us to you will be delivered by email to the address registered on your account or via in-app notification. Notices from you to us must be sent to support.thetradingterminal@gmail.com.
Updates to These Terms. We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the change takes effect. Continuing to use the Service after the effective date of the updated Terms constitutes your acceptance.

1. Who We Are

2. What Personal Data We Collect and Why
2.1 Account and Identity Data
When you register, we collect:
Email address — used to create and identify your account, send service notifications, and (where you opt in) marketing communications.
Display name — used to personalise your in-app experience.
Authentication tokens and session identifiers — used to keep you logged in securely.
Legal basis: Performance of our contract with you; our legitimate interest in securing accounts.
2.2 Payment and Billing Data
When you subscribe to a paid plan, billing is processed by Stripe, Inc. We receive from Stripe:
Payment status (succeeded/failed), subscription plan, and renewal dates.
Last four digits of your card and card expiry date (for display in your billing settings).
Stripe customer ID and subscription ID.
We do not receive or store your full card number, CVV, or bank account details. Those are handled exclusively by Stripe.
Legal basis: Performance of our contract (processing your payment and maintaining your subscription).
2.3 Trade and Journal Data
When you use the Service, you voluntarily provide:
Trade entries — entry/exit prices, lot sizes, stop loss, take profit, P&L, session, outcome.
Notes, tags, setups, confluences, and mistake records you choose to attach to trades.
Screenshots and images you upload.
Trading account metadata (account name, broker, account type, balance, drawdown limits).
Broker API credentials (Elite Auto-Logger users only) — stored securely to enable read-only trade sync.
This is your content. We process it solely to provide you with the journaling and analytics features of the Service.
Legal basis: Performance of our contract.
2.4 Usage and Technical Data
We may automatically collect:
IP address and approximate geolocation (country/region).
Browser type, operating system, and device type.
Pages visited within the Service and features used.
Error logs and diagnostic data.
This data is used to maintain and improve the Service, diagnose problems, and ensure security.
Legal basis: Our legitimate interest in operating a reliable, secure service.
2.5 Communications
If you contact us by email, we retain those communications to respond to your query and to improve our support.
Legal basis: Our legitimate interest in providing customer support.
3. Cookies and Local Storage
The Service uses browser localStorage (not traditional cookies) to store:
Your tab and page preferences.
Filter and display settings you have selected.
Your authentication session token.
We do not use third-party advertising cookies or tracking pixels. We do not serve ads through the Service. If we introduce any analytics tool that uses cookies in the future, we will update this policy and, where required, obtain your consent.
4. Third-Party Data Processors
We share your data only with the following sub-processors, who process it on our behalf to provide the Service:
Stripe, Inc. (Payment Processing)
Processes card payments and manages subscription billing. Your full card details go directly to Stripe and are never seen by us. Stripe is PCI-DSS compliant. See stripe.com/privacy.
Data may be processed in: United States and European Union (Stripe infrastructure).
Supabase, Inc. (Database, Authentication, and File Storage)
Hosts our PostgreSQL database (which contains your account and trade data), manages authentication (sign-in, magic links, OTP), and stores uploaded screenshots and files.
Data may be stored in: AWS ap-southeast-1 (Singapore).

Vercel, Inc. (Hosting and Serverless Functions)
Hosts the Service and runs server-side functions (including the economic news calendar proxy). Request data (including IP addresses) may be processed by Vercel's infrastructure.
Data may be processed in: Global CDN edge network; primary serverless function infrastructure in the United States.

We do not sell, rent, or trade your personal data to any third party. We will disclose data to law enforcement or regulatory bodies only where required by law or valid legal process.
5. International Data Transfers
Your data may be transferred to and processed in countries outside your own — including the United States, Singapore, and the European Union — by Stripe, Supabase, and Vercel. All three processors maintain data protection commitments and, where applicable to EEA or UK users, we rely on Standard Contractual Clauses for such transfers. 6. Data Retention
We retain your data for the following periods:
Account and trade data — retained for as long as your account is active.
After account deletion — we process deletion requests within 30 days. Automated backups may retain data for up to an additional 90 days before permanent removal.
Payment records — retained for 7 years from the date of transaction, as required for tax and accounting purposes (even after account deletion).
Server logs and diagnostics — retained for up to 90 days, then deleted automatically.
Support communications — retained for up to 2 years after the issue is resolved.
7. Your Rights
Depending on where you are located, you may have the following rights regarding your personal data:
Access — request a copy of the personal data we hold about you.
Correction — ask us to correct inaccurate or incomplete data.
Deletion — request that we delete your account and associated personal data.
Data portability — request your trade data in a structured, machine-readable format (we support CSV export from within the app).
Restriction — ask us to restrict processing of your data in certain circumstances.
Objection — object to processing based on legitimate interests.
To exercise any of these rights, email us at support.thetradingterminal@gmail.com. We will respond within 30 days. In some cases we may need to verify your identity before acting on a request.
If you are located in the European Economic Area (EEA) or the United Kingdom, you have the right to lodge a complaint with your local supervisory authority. For Australian users, you may also contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
8. Children's Privacy
The Service is not directed at individuals under the age of 18. We do not knowingly collect personal information from children under that age. If you believe we have collected information from a minor, please contact us immediately at support.thetradingterminal@gmail.com and we will delete it promptly.
9. Security
We take reasonable technical and organisational measures to protect your personal data, including:
Encryption of data in transit using TLS/HTTPS.
Secure credential management via Supabase Auth (passwords are hashed; we do not store plaintext passwords).
Restricted internal access to personal data on a need-to-know basis.
Secure storage of broker API keys with access limited to the Auto-Logger function.
No method of transmission or storage is 100% secure. While we do our best to protect your data, we cannot guarantee absolute security. In the event of a data breach that is likely to result in a high risk to your rights and freedoms, we will notify you and any relevant authorities as required by law.
10. Links to Third-Party Services
The Service may contain links to external websites (for example, broker websites or prop firm research links). This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party services you use.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by email or via an in-app notification at least 14 days before the change takes effect. The “Last updated“ date at the top of this document reflects the most recent revision. Continued use of the Service after the effective date of an updated policy constitutes your acceptance of the changes.
